1. Copyright and the DMCA
CHIVAM BLOGS respects the intellectual property rights of others and expects visitors and users to do the same. This DMCA Takedown Policy describes the process by which copyright owners may request removal of infringing content, and how users whose content has been removed may submit a counter-notice.
This policy is established in compliance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”).
2. Our Original Content
All original articles, blog posts, graphics, logos, design elements, and creative work published on CHIVAM BLOGS are protected by copyright law and are the exclusive property of CHIVAM SERVICES, unless otherwise stated. You may not reproduce, distribute, republish, scrape, or create derivative works from our content without our express written permission.
If you wish to quote or excerpt our content, standard journalistic fair use principles apply — brief excerpts with a clear attribution and link back to the original source are generally acceptable. Full article reproduction is not permitted without written consent.
3. Designated DMCA Agent
To report a copyright infringement on this Site, or to file a DMCA-compliant takedown notice, send a written notification to our designated DMCA agent:
DMCA Agent: CHIVAM SERVICES
Email: legal@chivamservices.com
Subject line: DMCA Takedown Notice
4. How to File a Takedown Notice
To be valid, a DMCA takedown notice must be a written communication (email is acceptable) that includes all of the following:
- Your identity — Your full name, mailing address, telephone number, and email address. If you are acting on behalf of a copyright owner, state your relationship to them and your authority to act on their behalf.
- Identification of the copyrighted work — Describe the copyrighted work you claim has been infringed. If multiple works are being reported, provide a representative list.
- Location of infringing material — Provide the specific URL(s) on this Site where the allegedly infringing material appears. General descriptions of the website are insufficient.
- Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement — A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner's behalf.
- Signature — Your physical or electronic signature.
Incomplete notices will not be processed. We reserve the right to request additional information to verify the validity of a notice.
5. Our Response Process
Upon receiving a complete, valid DMCA takedown notice:
- We will acknowledge receipt within 5 business days.
- We will review the notice and, if valid, remove or disable access to the allegedly infringing content promptly.
- We will notify the uploader (where applicable) that the content has been removed and provide them with a copy of the notice.
- The uploader may submit a counter-notice (see Section 6 below).
6. Counter-Notice Procedure
If you believe content was removed as a result of mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include:
- Your identity — Your full name, mailing address, telephone number, and email address.
- Identification of removed material — Description of the material that was removed and the URL(s) where it previously appeared.
- Good faith statement — A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the US, any judicial district in which CHIVAM SERVICES may be found), and that you will accept service of process from the original complainant or their agent.
- Signature — Your physical or electronic signature.
Upon receiving a valid counter-notice, we may restore the removed content within 10 to 14 business days unless the original complainant notifies us that they have filed a court action to prevent the restoration.
Submit counter-notices to: legal@chivamservices.com — Subject: “DMCA Counter-Notice”
7. Repeat Infringer Policy
CHIVAM BLOGS has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. Where the Site's community features detect a pattern of copyright infringement by a specific user, their access will be revoked.
8. Misuse of DMCA Notices
Submitting a DMCA takedown notice in bad faith — knowing that the material does not actually infringe your copyright — is a federal violation under 17 U.S.C. § 512(f), which provides for liability including damages, costs, and attorney fees. We will pursue our legal remedies against parties who abuse the DMCA process.
9. Protection of Our Own Content
If you find CHIVAM BLOGS content reproduced without permission on other websites, you may report it to us at legal@chivamservices.com. We actively protect our original content and will file DMCA notices on our own behalf where appropriate.
